PHYCOMANIA, as the responsible entity under data protection guidelines, commits to protecting the personal data and privacy of its customers and to treating them with complete confidentiality. "Profiling" means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.
"Pseudonymisation" means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.
"Filing System" means any structured set of personal data which are accessible according to specific criteria, whether centralised, decentralised, functional or geographical in nature.
"Controller" means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.
"Processor" means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the Controller.
"Recipient" means a natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients; the processing of those data by those public authorities shall be in compliance with the applicable data protection rules according to the purposes of the processing.
"Third Party" means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.
"Consent" of the data subject means any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.
Lawfulness of Processing
Processing of personal data is lawful only if, and to the extent that, it is based on a legal ground. The legal grounds for processing, pursuant to Article 6(1)(a)-(f) of the GDPR, can be defined as follows:
The data subject has given consent to the processing of their data for one or more specific purposes;
Processing is necessary for the performance of a contract to which the data subject is a party or in order to take steps at the request of the data subject prior to entering into a contract;

When you visit our website for informational purposes, PHYCOMANIA only collects personal data that the client's browser transmits to PHYCOMANIA's server. PHYCOMANIA uses this data exclusively for the purpose of contract execution and communication with the customer, where applicable. This includes contractual phases such as initiation, conclusion, processing, warranty (if applicable), and termination. This data will be retained until the contract ends. If retention periods exist for commercial and tax data, the storage period can extend up to 10 years.
The legal basis for this processing is Art. 6 para. 1 p. 1 point b of the GDPR for contract execution. The legal basis for any other retention under commercial or tax law is necessity, pursuant to Art. 6 para. 1 p. 1 point c of the GDPR.
PHYCOMANIA discloses its customers' personal information only for the necessary duration and for the purposes of contract execution or protecting its legitimate interests. PHYCOMANIA uses external service providers (order processors) for contract execution. Separate data processing agreements are concluded with these providers to ensure the protection of customers' personal data.
For the purpose of delivery, the customer's first name, last name, email address, and phone number are transmitted to the shipping company. This data transfer occurs solely within the scope of fulfilling the contractual relationship with you as a customer.

For the payment process, the customer's payment data, including their first name, last name, address, email address, and phone number, will be transferred to the respective payment service provider.
This data is processed for the purpose of establishing the contractual relationship with you as a customer or based on your duly given consent. The legal basis is Art. 6 para. 1 p. 1 point b of the GDPR.
PHYCOMANIA uses its customers' personal data to send them a newsletter, if applicable, provided the customer has given prior authorization for this use.
The only data required for sending the newsletter is the email address. Providing other separately identified information is voluntary, and this information will be used to communicate with the customer personally. Upon confirmation, PHYCOMANIA records the customer's email address for the purpose of sending them the newsletter.
Customers may withdraw their consent to receive the newsletter at any time by unsubscribing. This withdrawal can be expressed by clicking the link included in each newsletter email or by sending an email to support@phycomania.support.
PHYCOMANIA evaluates user behavior when sending newsletters. To perform this evaluation, the emails sent contain web beacons or invisible pixels, which are single-pixel GIF files installed on the PHYCOMANIA website. For these evaluations, data provided by users and web beacons are associated with the email address and a user ID. This data is collected in a completely anonymous manner, meaning that identifiers are not linked to the user's other personal data, and any direct personal reference is excluded. Users can object to this tracking at any time by clicking the specific link provided in each email or by informing PHYCOMANIA through another communication channel. This information will be retained as long as the user remains subscribed to the newsletter. After unsubscribing, PHYCOMANIA keeps this data for purely statistical and anonymous purposes.
The processing of this data is based on the consent provided by the customer, with the legal basis being Art. 6 para. 1 p. 1 point a) of the GDPR.
We use social application plugins (hereinafter referred to as: plugins) from social networks such as Facebook, YouTube, and Instagram.
We use what is known as the two-click solution. This means that when you visit our site, no personal data is initially transmitted to these plugin providers. You can identify the plugin provider by the marking on the grayed-out button, located above the first letter of the name or its logo. We offer you the option to communicate directly with the provider of this plugin via this button. Facebook also provides a range of statistical data for SBS-Legal as the fan page administrator within the framework of the statistical function (called "Insights"). These statistics are generated and made available by Facebook. As the fan page administrator, we have no influence over this generation; we are not precisely able to prevent this function. In the "Statistics" function, the following information is presented to us for the categories "Fans", "Subscribers", "People Reached", and "Interactions", each for a duration to be determined:
Page activity such as "page views", "page previews", "page actions"; "Reach" activity (ability to reach an audience) such as "Likes", people reached, and recommendations; Post activity such as post interactions, video views, comments, content sharing.
Furthermore, we receive statistical information about Facebook groups associated with our fan page. In accordance with Facebook's terms of use, which every user accepts when creating a Facebook profile, we can also identify subscribers and fans of the page and view their profiles and other shared information.

We retain the information provided by Facebook as long as you have not deemed it necessary to delete or depersonalize it.

We suggest you address your requests for information or any other questions about your rights, as listed at the end of this document, directly to Facebook, as Facebook alone has full and complete access to user data. If, by chance, your request is sent to us, we will process it as customary and forward it to Facebook.
