These Terms and Conditions define the Agreement between PHYCOMANIA s.r.o. and each user of this website. The information on this website is provided for informational purposes only. It is not intended to replace the advice of your doctor or other healthcare professional, or any information contained on or in product labeling or packaging. You should not use the information on this website to diagnose or treat a health problem, or to prescribe medication or other treatment. PHYCOMANIA s.r.o. accepts no responsibility for the content of this website.

Please read these General Terms and Conditions carefully before placing your order with PHYCOMANIA s.r.o. These General Terms and Conditions contain important information regarding the ordering, processing, fulfillment, and delivery of products, including limitations of liability.

As a condition of using this website, you agree not to use this site or any software application for any illegal activity or activity prohibited by these Terms and Conditions. You may not use this site or any software application that may damage, disable, overload, or impair this site, or interfere with its operation and use by any third party, or any software application. You agree not to hack into areas of this site or software applications that are not intentionally made accessible by PHYCOMANIA s.r.o.

Definitions

"Agreement" means the agreement defined by the terms set forth in this document between you and PHYCOMANIA s.r.o. and includes any amendments to this Agreement.

"Delivery Address" means the address to which the Products are to be delivered, as indicated on the electronic order form on the website.

“Products” refers to the items offered for sale, described, or displayed on the site.

"Order" means a request by you to purchase Products from PHYCOMANIA s.r.o. in accordance with these Terms and Conditions.

"Price" means the purchase price of each Product as specified on the website.

"You," "Your," and "User" refer to a purchaser or prospective purchaser of the Products, whether an individual or a business.

1 Resale Rules

PHYCOMANIA s.r.o. supplies the Products for your own use and not for resale (with the exception of Professionals) or any other commercial activity. By placing an Order, you agree not to export or resell, directly or indirectly, the Products or any product incorporating them. Professionals (animal professionals such as veterinarians, trainers, and human professionals such as therapists—the list is not exhaustive) are authorized and encouraged to purchase Products from PHYCOMANIA s.r.o. for resale.
Promoters (athletes, influencers, therapists, etc.) will receive a promo code offering a percentage discount on the total price of the product incl. excl. VAT the Order placed by the buyers they have referred, and a percentage commission on the total price of the product, excluding VAT, of the Orders placed by the buyers they have referred.

2 Registration on the Website

(1) To place an Order, you must register as a User, and no one is authorized to use another User's account without their express permission. When registering, you must specify whether you are an Individual or a Professional. Professionals have access to the purchase of Phyco Animo and are encouraged to resell the Products at a discount and all other Products at the normal price. When completing your registration, you must provide personal information, such as your name and address (Professionals: company name, company registration number, address, VAT number, specialization) and a valid email address. You agree to provide accurate and complete information and to keep it up to date. A username is required for registration and promotional purposes only. As a User, you are solely responsible for all activity on your account, and it is your responsibility to maintain the protection and confidentiality of your account password. If you suspect or become aware that your password has been compromised or your account has been used without your authorization, you must notify us immediately.

3 Offer and Acceptance

The presentation of Products on the Website does not constitute an offer to sell. It is merely an invitation to trade, and the orders you place are offers to purchase specific Products in accordance with the terms of this Agreement at the Price indicated (including delivery and other charges). PHYCOMANIA s.r.o. reserves the right to accept or refuse your Offer for any reason (or no reason), including, but not limited to, the unavailability of Products, an error in the Price or description of Products, or an error in your Order.
PHYCOMANIA s.r.o. may cancel or suspend an Order at any time due to the inability to authorize a payment, the discovery of an incorrect Item Price, or for any other reason at its discretion. An Order you submit on the Website is an Offer by you to purchase Products at the Price indicated at the time you submit the Order. PHYCOMANIA s.r.o. is entitled to accept the Offer within two weeks. When you place an Order for one or more Products, you acknowledge that:
All information relating to the Products and any material produced by PHYCOMANIA s.r.o. is provided in good faith, and any errors in any quotation, commercial documentation, or other document or information issued by PHYCOMANIA s.r.o. or placed on the Website may be corrected without PHYCOMANIA s.r.o. assuming any liability whatsoever;
If the price of the products is changed or if a material difference is made in the specifications of the products, you have the right to cancel your Order and obtain a refund of their price as well as the reasonable and applicable cost of the carrier.
PHYCOMANIA s.r.o. reserves the right to increase the price of products to reflect any increase in cost to PHYCOMANIA s.r.o. due to any factor beyond the control of PHYCOMANIA s.r.o. (such as, without limitation, any currency fluctuations, monetary regulations, changes in duties, shipping costs, or material increases in the costs of products for PHYCOMANIA s.r.o.).
PHYCOMANIA s.r.o. may make changes to product/ingredient specifications to comply with any legal or European Union requirements or, where products are to be supplied according to PHYCOMANIA s.r.o. specifications, that do not materially affect their quality or performance (or when specific products are unavailable, to replace the products ordered with other products that are substantially similar in nature and price).
PHYCOMANIA s.r.o. reserves the right to inform you that the products you have ordered are no longer available. Subject to these Terms and Conditions, if you order a product on the Website and PHYCOMANIA s.r.o. later informs you that it no longer stocks that product, or cannot supply your order, PHYCOMANIA s.r.o. will offer you a credit or refund for the value of the products that were not supplied to you, including delivery costs.

4 Price and Payment

The price of products is indicated on the Website. For Professionals, the price is displayed excluding tax until the delivery destination is indicated. For Individuals, prices are displayed including all taxes.
All payments due must be received in full at the time of Order. If your payment is not received or is declined by your bank or credit card issuer, we cannot reserve Products on your behalf or begin manufacturing the Products you have ordered.
PHYCOMANIA s.r.o shall not be liable for any loss or damage you may suffer if a third party gains unauthorized access to the data you provided to PHYCOMANIA s.r.o when placing an order on the Website.
PHYCOMANIA s.r.o remains the owner of products ordered via the Website until the total amount due has been received. The risks associated with all products ordered, such as loss or damage, are transferred to you on the date of shipment.

5 Delivery

In accordance with this Agreement, PHYCOMANIA s.r.o. will supply you with the products as detailed in the order confirmation. PHYCOMANIA s.r.o. will do its best to deliver orders within the times specified for shipping and delivery. However, many external factors may affect these times and PHYCOMANIA s.r.o. cannot guarantee that they will always be met. Personal collection of products is not available. Please note that a signature may be required upon delivery depending on the carrier's policy.
PHYCOMANIA s.r.o. cannot guarantee that the products will be stored in a customs warehouse, free zone, or bonded warehouse in accordance with the conditions established by the manufacturer.
You must take into account the specific nature of the main ingredient, Phycocyanin, which is freshly cultivated for each new order sent to the manufacturer. The cultivation time required is generally around 4 weeks, but can be significantly extended by uncontrollable external factors. In this regard, such production delays cannot constitute a delivery delay.
If delivery is delayed due to force majeure, extraordinary circumstances, or an act or omission on the part of a component supplier or service provider of PHYCOMNIA s.r.o. (electricity, etc.), the delivery period will be extended taking into account all relevant circumstances.

6 Testing, Quality Assurance

PHYCOMANIA s.r.o. undertakes to maintain quality assurance systems to control the quality of components, processing, testing, and packaging processes, in accordance with its usual policies and practices, and in accordance with all additional requirements set forth in this Agreement. A laboratory analyzes each production run for bacterial contamination prior to delivery.
PHYCOMANIA s.r.o. will do its utmost to prevent and, where necessary, quickly remedy any conditions that could compromise the quality or reliability of its products or manufacturing process. PHYCOMANIA s.r.o. performs standard control tests on all its products.

7 Acceptance of Products

You are required to inspect and test any Product delivered hereunder, and you will accept or reject such Products in accordance with the following terms and conditions.
Products delivered by PHYCOMANIA s.r.o. must be inspected and tested by you within fourteen (14) days of receipt at the delivery address specified on the applicable order. Products not rejected during this fourteen (14) day period will be deemed accepted.
PHYCOMANIA s.r.o. is not obligated to refund an order or authorize an exchange simply because you wish to cancel your purchase. We recommend that you make a careful decision before placing an order.

8 Compensation

You agree to indemnify, defend, and hold harmless PHYCOMANIA s.r.o. and our parent company, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

9 Disclaimer of Warranties and Limitation of Liability

PHYCOMANIA s.r.o. disclaims all implied warranties and similar obligations that go beyond the express warranties set forth in the Agreement. The Products delivered are (unless expressly stated by us) provided "as is" and "as available" for your use, without any representation, warranty, or condition of any kind, express or implied, including any implied warranties or conditions of merchantability, fitness for a particular purpose, durability, title, and non-infringement.
In no event shall PHYCOMANIA s.r.o., our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, revenue, savings, or data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising out of your use of any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the website. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions, the liability of PHYCOMANIA s.r.o. shall be limited to the value of the products you ordered.

10 Applicable law, jurisdiction

(1) This contract shall be governed by the laws of the Czech Republic.

(2) The place of performance and exclusive place of jurisdiction for all disputes arising from or in connection with this contract shall be Prague, Czech Republic.
